Terms and conditions
GENERAL TERMS AND CONDITIONS OF CONTRACTING
The contracting of any of the services offered by the travel agency CUSCO MANTA TOUR S.R.L. (hereinafter referred to as THE AGENCY) implies the full acceptance of these General Terms and Conditions. Both THE CLIENT and THE AGENCY expressly agree to and accept each of the clauses described herein.
RATES: All prices are expressed in U.S. dollars and/or Peruvian soles, according to the exchange rate in effect at the time of publication. Conversion to local currency will be based on the exchange rate established by THE AGENCY at the time each payment is made. Any variation in taxes, entrance fees, tourism services, or exchange rates may result in adjustments to the final price of the contracted service.
To confirm a reservation, THE AGENCY requires an advance payment equivalent to 40% of the total contracted services, which may be made through the authorized payment methods. The remaining balance must be paid by THE CLIENT upon arrival in Peru, either in cash or by credit card. Credit card payments are subject to an additional 8% surcharge corresponding to banking and operational fees. All transfer and transaction fees must be assumed entirely by THE CLIENT.
SERVICES INCLUDED: Rates include only those services expressly detailed in the reservation confirmation sent by THE AGENCY.
SERVICES NOT INCLUDED: Any services not expressly specified in the reservation confirmation are not included, including but not limited to:
- Excess baggage charges, visas, airport taxes, tips, insurance, beverages, special meals, optional hotel services, laundry, current or future taxes, and any other unspecified expenses.
- Expenses caused by delays, cancellations, or modifications of flights, land transportation, or other services due to weather conditions, strikes, technical problems, or circumstances beyond THE AGENCY’S control.
- Meals and beverages during routes or transfers unless expressly specified as included.
DOCUMENTATION: It is the sole responsibility of THE CLIENT to carry all required travel documentation, including a valid passport, visas, special permits, and any other requirements established by the corresponding immigration authorities. Additionally, during their stay in Peru, THE CLIENT must carry personal documents and the Andean Migration Card (TAM) at all times, as this document is required for exemption from local tourism taxes applicable to foreign visitors.
LUGGAGE: Luggage and personal belongings are the exclusive responsibility of THE CLIENT. THE AGENCY shall not be held responsible for loss, theft, damage, or deterioration occurring during the trip or the provision of tourism services.
HOTELS: The category and quality of the hotels offered correspond to the official tourist classification of each establishment. In exceptional situations such as overbooking, special events, or circumstances beyond THE AGENCY’S control, THE AGENCY may replace the confirmed accommodation with another of similar or superior category.
Additional expenses caused by delays, cancellations, weather conditions, technical issues, strikes, or any force majeure event shall be assumed by THE CLIENT. Rooms provided are standard category unless otherwise expressly indicated in writing.
REFUNDS: To secure a reservation, THE CLIENT must make an initial payment equivalent to forty percent (40%) of the total contracted service value. No reservation will be considered confirmed until such payment has been received and validated by THE AGENCY.
Before final confirmation, services may be subject to operational or rate modifications. In the event of substantial changes, THE CLIENT may choose to cancel the operation and request a refund of the amounts paid as a reservation deposit, provided that the involved suppliers allow such refund.
CLIENT CANCELLATIONS AND/OR TRIP CANCELLATION: THE CLIENT may request cancellation of contracted services at any time through written communication sent to THE AGENCY. Depending on the type of service and supplier policies, administrative fees, penalties, or cancellation charges may apply.
- Administrative and management expenses incurred by THE AGENCY.
- Penalties applied by hotels, tour operators, airlines, or other involved providers.
- Additional penalties according to the specific conditions of the contracted service. Some services, such as issued airline tickets, Inca Trail permits, Machu Picchu or Huayna Picchu entrance tickets, and special reservations, are subject to strict no-refund policies or 100% cancellation penalties regardless of the notice period provided.
In the event that THE CLIENT does not appear on the scheduled service date without prior documented notice, it will be considered a “No Show,” automatically resulting in the loss of the right to any refund and the contracted service.
